1 A bill to be entitled
2 An act relating to regional planning councils;
3 amending s. 186.504, F.S.; prescribing
4 membership in the councils; providing an
5 effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 186.504, Florida Statutes, is
10 amended to read:
11 186.504 Regional planning councils; creation;
12 membership.--
13 (1) A regional planning council shall be created in
14 each of the several comprehensive planning districts of the
15 state. Only one agency shall exercise the responsibilities
16 granted herein within the geographic boundaries of any one
17 comprehensive planning district.
18 (2) Membership on the regional planning council shall
19 be as follows:
20 (a) Representatives appointed by each of the member
21 counties in the geographic area covered by the regional
22 planning council.
23 (a)(b) Representatives appointed by each of the from
24 other member local general-purpose governments in the
25 geographic area covered by the regional planning council which
26 choose to be members.
27 (b)(c) Representatives appointed by the Governor from
28 the geographic area covered by the regional planning council.
29 (3) Not less than two-thirds of the representatives
30 serving as voting members on the governing bodies of such
31 regional planning councils shall be elected officials of local

1 general-purpose governments chosen by the cities and counties
2 of the region, provided each local general-purpose government
3 that is a member county shall have at least one vote. The
4 remaining one-third of the voting members on the governing
5 board shall be appointed by the Governor, subject to
6 confirmation by the Senate, and shall reside in the region.
7 No two appointees of the Governor shall have their places of
8 residence in the same county until each county within the
9 region is represented by a Governor's appointee to the
10 governing board. Nothing contained in this section shall deny
11 to local governing bodies or the Governor the option of
12 appointing either locally elected officials or lay citizens
13 provided at least two-thirds of the governing body of the
14 regional planning council is composed of locally elected
15 officials.
16 (4) In addition to voting members appointed pursuant
17 to paragraph (2)(c), the Governor shall appoint the following
18 ex officio nonvoting members to each regional planning
19 council:
20 (a) A representative of the Department of
21 Transportation.
22 (b) A representative of the Department of
23 Environmental Protection.
24 (c) A representative of the Department of Commerce.
25 (c)(d) A representative of the appropriate water
26 management district or districts.

28 The Governor may also appoint ex officio nonvoting members
29 representing appropriate metropolitan planning organizations
30 and regional water supply authorities.

1 (5) Nothing contained in this act shall be construed
2 to mandate county or municipal government membership or
3 participation in a regional planning council. However, each
4 county shall be a member of the regional planning council
5 created within the comprehensive planning district
6 encompassing the county.
7 (6) The existing regional planning council in each of
8 the several comprehensive planning districts shall be
9 designated as the regional planning council specified under
10 subsections (1)-(5), provided the council agrees to meet the
11 membership criteria specified therein and is a regional
12 planning council organized under either s. 163.01 or s. 163.02
13 or chapter 160.
14 Section 2. This act shall take effect upon becoming a
15 law.

18 SENATE SUMMARY
19 Deletes the requirement that a county must be a member of
a regional planning council. Provides that
20 representatives on such council may be appointed by a
local general-purpose government in the geographic area
21 covered by a regional planning council which chooses to
be a member of the council.
