ENROLLED 1997 Legislature HB 619, First Engrossed 1 2 An act relating to the Matlacha and Pine Island 3 Fire Control District, Lee County; repealing 4 ss. 12, 13, 14, and 15 of ch. 63-1558, Laws of 5 Florida, as amended, relating to emergency 6 ambulance service, annual assessments therefor, 7 adoption of fees or service charges, and 8 requirement of a referendum election in order 9 to dissolve the district; creating new ss. 12 10 and 13 of ch. 63-1558, Laws of Florida, as 11 amended; providing for emergency medical rescue 12 response services; providing for the levying of 13 taxes to support same; renumbering subsequent 14 sections of ch. 63-1558, Laws of Florida, as 15 amended; providing for a referendum; providing 16 an effective date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Sections 12, 13, and 14 of chapter 63-1558, 21 Laws of Florida, as amended by chapter 79-501, Laws of 22 Florida, are hereby repealed, and remaining sections are 23 renumbered accordingly. 24 Section 2. Section 12 of chapter 63-1558, Laws of 25 Florida, as amended by chapter 79-501, Laws of Florida, is 26 created to read: 27 Section 12. The Fire Control Board of the Matlacha and 28 Pine Island Fire Control District shall have the right, power, 29 and authority to employ such personnel as deemed necessary for 30 the proper function and operation of the Fire Department for 31 the establishment and maintenance of emergency medical and 1 CODING: Words stricken are deletions; words underlined are additions. ENROLLED 1997 Legislature HB 619, First Engrossed 1 rescue response services, and for the acquisition and 2 maintenance of rescue, medical, and other emergency equipment, 3 subject to the provisions of chapter 401, Florida Statutes, 4 and any certificate of public convenience and necessity or its 5 equivalent issued thereunder. 6 Section 3. Section 6 of chapter 63-1558, Laws of 7 Florida, is amended to read: 8 Section 6. Upon the receipt of such estimate and 9 certificate of posting, the Board of County Commissioners 10 shall cause the same to be recorded in the minutes of the 11 County Commissioners' meeting meetings, and at the time of 12 making and fixing the rate of annual taxation for county 13 purposes, said Board of County Commissioners shall fix and 14 cause to be levied on all property of said district, real and 15 personal, a millage sufficient to meet the requirements of 16 such estimate so made by said Fire Control Board, provided, 17 however, 3 two (2) mills is the maximum that can be levied in 18 any one year. 19 Section 4. The provisions of section 3 of this act 20 shall take effect only upon its approval by a majority vote of 21 those qualified electors of Lee County residing within the 22 district and voting in a referendum election to be called by 23 the Board of County Commissioners and to be held in accordance 24 with the provisions of general election laws. The costs of 25 such an election are to be paid by the Matlacha and Pine 26 Island Fire Control District. 27 Section 5. Except as otherwise provided herein, this 28 act shall take effect upon becoming a law. 29 30 31 2
