1 A bill to be entitled
2 An act relating to culpable negligence;
3 amending s. 784.05, F.S.; providing that a
4 person commits the offense of exposing another
5 to personal injury through culpable negligence,
6 when such person knowingly has permitted the
7 person's dog to run at large as a "pack of
8 dogs," as defined, and the pack of dogs
9 inflicts significant personal injury; providing
10 penalties; providing that a person commits the
11 offense of exposing another to personal injury
12 through culpable negligence when such person
13 knowingly has permitted the person's dog to run
14 at large as a pack of dogs and the death of any
15 person occurs from injury inflicted by the pack
16 of dogs; providing penalties; providing an
17 effective date.

19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. Subsection (5) is added to section 784.05,
22 Florida Statutes, to read:
23 784.05 Culpable negligence.--
24 (5) A person who violates subsection (1) by knowingly
25 permitting a dog or dogs owned by that person to run at large
26 as a pack of dogs, commits:
27 (a) If that pack of dogs inflicts significant injury
28 on any person, a misdemeanor of the first degree punishable as
29 provided in s. 775.082 or s. 775.083; or
30 (b) If death of any person occurs from injury
31 inflicted by the pack of dogs, a felony of the third degree,

1 punishable as provided in s. 775.082, s. 775.083, or s.
2 775.084.

4 As used in this subsection, the term "pack of dogs" means more
5 than two dogs engaged in the same activity.
6 Section 2. This act shall take effect October 1, 1998,
7 and shall apply to offenses committed on or after that date.

Provides that a person commits the offense of exposing
12 another to personal injury through culpable negligence,
when such person knowingly has permitted the person's dog
13 to run at large as a "pack of dogs," as defined, and the
pack of dogs inflicts significant personal injury.
14 Provides first-degree misdemeanor penalties.
