5 requirements; requiring insurance coverage

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 316.211, Florida Statutes, is
12 amended to read:
13 316.211 Equipment for motorcycle and moped riders.--
14 (3) This section shall not apply to persons riding
15 within an enclosed cab or to any person 16 years of age or
16 older who is operating or riding upon a motorcycle powered by
17 a motor with a displacement of 50 cubic centimeters or less or
18 is rated not in excess of 2 brake horsepower and which is not
19 capable of propelling such motorcycle at a speed greater than
20 30 miles per hour on level ground, or to persons over the age
21 of 21 years. In order to ride a motorcycle without wearing
22 protective headgear a person over the age of 21 must obtain
23 bodily injury liability in the minimum amount of $20,000 per
24 person, $40,000 per accident and medical payment coverage for
25 the driver and all passengers of the motorcycle of at least
26 $10,000 for the driver and each person. The operator of the
27 motorcycle must have proof of insurance on his or her person
28 in order to operate the motorcycle and shall be required to
29 provide proof of insurance upon demand by any law enforcement
30 officer.
31 Section 2. This act shall take effect July 1, 1997.
