  1                      A bill to be entitled

  2         An act relating to Pahokee Water Control

  3         District, Palm Beach County; amending chapter

  4         10002, Laws of Florida, 1923, as amended, to

  5         provide that the Board of Supervisors shall be

  6         composed of three citizens of the United

  7         States, who shall be resident freeholders of

  8         the State of Florida, and expanding the

  9         boundaries of said district to include land

10         from Pelican Lake Water Control District;

11         repealing chapter 28417, Laws of Florida, 1953,

12         as amended, which authorizes the Pahokee Water

13         Control District to provide water control to

14         Pelican Lake Sub-Drainage District; providing

15         for severability; providing an effective date.

17  Be It Enacted by the Legislature of the State of Florida:

18

19         Section 1.  Section 1 of chapter 10002, Laws of

20  Florida, 1923, as amended, is amended by adding an additional

21  paragraph, to read:

22         The Board of Supervisors of Pahokee Water Control

23  District shall be composed of three citizens of the United

24  States, who shall be resident freeholders of the State of

25  Florida.

26         Section 2.  Chapter 28417, Laws of Florida, 1953, as

27  amended, is hereby repealed.

28         Section 3.  Section 2 of chapter 10002, Laws of

29  Florida, 1923, as amended, is amended by adding additional

30  paragraphs, to read:

  1         The territorial limits of Pahokee Water Control

  2  District shall also embrace and include those parcels of land

  3  consisting of 892.65 acres, described as follows:

  4         Section 19 and that part of Section 18 lying South of

  5  the West Palm Beach Canal, Township 42 South, Range 38 East,

  6  more particularly described as follows:

  7         Beginning at a point where the south right-of-way line

  8  of Conner's Highway (designated as State Road No. 716)

  9  intersects the west line of Section 18, Township 42 South,

10  Range 38 East;

11         Thence south along the west line of Sections 18 and 19

12  to the southwest corner of Section 19;

13         Thence east along the south line of Section 19 to the

14  southeast corner of said section;

15         Thence north along the east line of Sections 19 and 18

16  to a point where the east line of said Section 18 intersects

17  the south right-of-way line of Conner's Highway;

18         Thence in a northwesterly direction along the south

19  right-of-way line of Conner's Highway to a point where said

20  right-of-way line intersects the west line of Section 18, the

21  same being the point of beginning.

22         Section 4.  The above-described parcels of land are

23  removed from within the boundary lines of Pelican Lake Water

24  Control District, a corporation under the drainage laws of the

25  State of Florida, existing in Palm Beach County.

26         Section 5.  If any section, clause, or provision of

27  this act shall for any reason be declared invalid or

28  unconstitutional, the remaining portions of this act shall

29  remain in full force and effect.

30         Section 6.  This act shall take effect upon becoming a

31  law.
