11  The Committee on Rules, Resolutions, & Ethics offered the

12  following:

14         Technical Amendment (with title amendment) 

15         On page 1, line 14, through page 2, line 9,

16  remove from the bill:  all of said lines

18  and insert in lieu thereof:

19         Section 2.  Subsection (1) of section 938.09, Florida

20  Statutes, is amended to read:

21         938.09  Cases in which victim is handicapped or

22  elderly.--

23         (1)  When any person pleads guilty or nolo contendere

24  to, or is convicted of, any felony or misdemeanor under the

25  laws of this state or any county or municipal ordinance

26  violation in which any victim is handicapped or elderly, as

27  defined in s. 426.002, there shall be imposed an additional

28  cost in the case, in addition to any other cost required to be

29  imposed by law, in the sum of $20. Under no condition shall a

30  political subdivision be held liable for the payment of such

31  sum of $20.

 1         Section 3.  Subsection (1) of section 938.11, Florida

 2  Statutes, is amended to read:

 3         938.11  Cases in which victim is handicapped or

 4  elderly.--

 5         (1)  In addition to any fine prescribed by law for any

 6  criminal offense or any county or municipal ordinance, when

 7  any victim of such criminal offense or any county or municipal

 8  ordinance violation is handicapped or elderly, as defined in

 9  s. 426.002, there is hereby assessed as a court cost an

10  additional 10-percent surcharge on such fine, which cost shall

11  be imposed by all county and circuit courts, and collected by

12  the clerk of the court together with such fine. The cost shall

13  be deposited in the General Revenue Fund.
