1 A bill to be entitled
2 An act relating to crime prevention assistance;
3 repealing ss. 426.001, 426.002, 426.003,
4 426.004, 426.005, 426.006, 426.007, 426.008,
5 and 426.009, F.S., relating to crime prevention
6 assistance; amending ss. 775.0836 and 939.015,
7 F.S., to conform; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Sections 426.001, 426.002, 426.003,
12 426.004, 426.005, 426.006, 426.007, 426.008, and 426.009,
13 Florida Statutes, are hereby repealed.
14 Section 2. Subsection (1) of section 775.0836, Florida
15 Statutes, is amended to read:
16 775.0836 Fines; surcharges in cases in which victim is
17 handicapped or elderly.--
18 (1) In addition to any fine prescribed by law for any
19 criminal offense or any county or municipal ordinance, when
20 any victim of such criminal offense or any county or municipal
21 ordinance violation is handicapped or elderly, as defined in
22 s. 426.002, there is hereby assessed an additional 10-percent
23 surcharge on such fine, which surcharge shall be imposed by
24 all county and circuit courts, and collected by the clerk of
25 the court together with such fine. The surcharge shall be
26 deposited in the General Revenue Fund.
27 Section 3. Subsection (1) of section 939.015, Florida
28 Statutes, is amended to read:
29 939.015 Cases in which victim is handicapped or
30 elderly; additional costs.--

1 (1) When any person pleads guilty or nolo contendere
2 to, or is convicted of, any felony or misdemeanor under the
3 laws of this state or any county or municipal ordinance
4 violation in which any victim is handicapped or elderly, as
5 defined in s. 426.002, there shall be imposed an additional
6 cost in the case, in addition to any other cost required to be
7 imposed by law, in the sum of $20. Under no condition shall a
8 political subdivision be held liable for the payment of such
9 sum of $20.
10 Section 4. This act shall take effect upon becoming a
11 law.
