1 A bill to be entitled
2 An act relating to minority business
3 enterprises; amending s. 287.09451, F.S.;
4 requiring certain persons doing business with
5 the state to submit a minority business
6 development plan; providing that failure to
7 submit a plan disqualifies a person from
8 bidding on state contracts for a period of
9 time; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (j) of subsection (4) of section
14 287.09451, Florida Statutes, is amended to read:
15 287.09451 Minority Business Advocacy and Assistance
16 Office; powers, duties, and functions.--
17 (4) The Minority Business Advocacy and Assistance
18 Office shall have the following powers, duties, and functions:
19 (j) To require any person that does encourage all
20 firms which do more than $1 million in business with the state
21 within a 12-month period to develop, implement, and submit to
22 this office a minority business development plan. Any person
23 that does not submit a minority business development plan
24 within 60 days after the end of the 12-month period is not
25 qualified to bid on any new state contract for a period of 12
26 months from the time the plan is due.
27 Section 2. This act shall take effect July 1, 1998.

2 SENATE SUMMARY
3 Requires a person who does more than $1 million in
business with the state to submit a minority business
4 development plan to the Minority Business Advocacy and
Assistance Office. Disqualifies a person who does not
5 submit a plan in a timely manner from bidding on any new
state contract for 1 year.
