  1                      A bill to be entitled

  2         An act relating to violent offenders; amending

  3         s. 945.092, F.S.; providing that a habitual

  4         violent felony offender or violent career

  5         criminal may not be placed in a work-release

  6         program or confined in a minimum security

  7         facility; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 945.092, Florida Statutes, is

12  amended to read:

13         945.092  Limits on work-release and minimum security

14  custody for persons who have committed the crime of escape and

15  for certain violent offenders.--

16         (1)  A person who has ever been convicted, regardless

17  of adjudication, of the offense of escape, as prohibited by s.

18  944.40 or its successor, or as prohibited by a similar law of

19  another state, is not eligible for any work-release program

20  under s. 945.091 or for confinement in minimum security

21  conditions.

22         (2)  A habitual violent felony offender or violent

23  career criminal, as defined in s. 775.084, is not eligible for

24  any work-release program authorized under 945.091 or any other

25  law and may not be confined in a minimum security facility.

26         Section 2.  This act shall take effect upon becoming a

27  law.
