18 Section 28. Effective July 1, 1997, paragraphs (a) and
19 (c) of subsection (1), subsection (2), and paragraph (a) of
20 subsection (3) of section 320.0848, Florida Statutes, 1996
21 Supplement, are amended to read:
22 320.0848 Persons who have disabilities; issuance of
23 disabled parking permits; temporary permits; permits for
24 certain providers of transportation services to persons who
25 have disabilities.--
26 (1)(a) The Department of Highway Safety and Motor
27 Vehicles or its authorized agents shall, upon application and
28 receipt of the fee, issue a disabled parking permit for a
29 period of 6 years that ends on the renewal date for that
30 person's driver's license or identification card to any person
31 who has long-term permanent mobility problems, or a temporary

1 disabled parking permit not to exceed 1 year to any person who
2 has temporary mobility problems. The application for a
3 disabled parking permit must contain the name and motor
4 vehicle policy number of the applicant's primary insurance
5 carrier, whom the department may notify upon granting a
6 disabled parking permit. The person must be currently
7 certified by a physician licensed under chapter 458, chapter
8 459, or chapter 460, or by a podiatrist licensed under chapter
9 461, by the Division of Blind Services of the Department of
10 Labor and Employment Security, or by a licensed physician
11 employed by a Veterans Administration Hospital or on a
12 military base in Florida, Georgia, Alabama, or Mississippi, or
13 by the Adjudication Office of the United States Department of
14 Veterans Affairs or its predecessor as being legally blind or
15 as having any of the following disabilities that limit or
16 impair his or her ability to walk:
17 1. Inability to walk 200 feet without stopping to
18 rest.
19 2. Inability to walk without the use of or assistance
20 from a brace, cane, crutch, prosthetic device, or other
21 assistive device, or without the assistance of another person.
22 If the assistive device significantly restores the person's
23 ability to walk to the extent that the person can walk without
24 severe limitation, the person is not eligible for the
25 exemption parking permit.
26 3. The need to permanently use a wheelchair.
27 4. Restriction by lung disease to the extent that the
28 person's forced (respiratory) expiratory volume for 1 second,
29 when measured by spirometry, is less than 1 liter, or the
30 person's arterial oxygen is less than 60 mm/hg on room air at
31 rest.

1 5. Use of portable oxygen.
2 6. Restriction by cardiac condition to the extent that
3 the person's functional limitations are classified in severity
4 as Class III or Class IV according to standards set by the
5 American Heart Association.
6 7. Severe limitation in the person's ability to walk
7 due to an arthritic, neurological, or orthopedic condition.
8 (c) The Department of Highway Safety and Motor
9 Vehicles shall renew the disabled parking permit of any person
10 who has a disability upon presentation of the certification
11 required by paragraph (b), for the period that coincides with
12 the period of the person's driver's license or identification
13 card.
14 (2) DISABLED PARKING PERMIT; PERSONS WITH LONG-TERM
15 PERMANENT MOBILITY PROBLEMS.--
16 (a) The disabled parking permit is a placard that can
17 be placed in a motor vehicle so as to be visible from the
18 front and rear of the vehicle. Each side of the placard must
19 have the international symbol of accessibility in a
20 contrasting color in the center so as to be visible. One side
21 of the placard must display the applicant's driver's license
22 number or state identification card number along with a
23 warning that the applicant must have such identification at
24 all times while using the parking permit. A validation sticker
25 must also be issued with each disabled parking permit, showing
26 the month and year of expiration and the holder's birth month
27 on each side of the placard. Validation stickers must be of
28 the size specified by the Department of Highway Safety and
29 Motor Vehicles and must be affixed to the disabled parking
30 permits. The disabled parking permits must use the same colors
31 as license plate validations.

1 (b) License plates issued under ss. 320.084, 320.0842,
2 320.0843, and 320.0845 are valid for the same parking
3 privileges and other privileges provided under ss. 316.1955,
4 316.1964, and 526.141(5)(a).
5 (c)1. Except as provided in subparagraph 2., the fee
6 for a disabled parking permit shall be:
7 a. Twenty-two dollars and fifty cents for the initial
8 6-year permit or renewal permit, of which the State
9 Transportation Trust Fund shall receive $20.25 and the tax
10 collector of the county in which the fee was collected shall
11 receive $2.25.
12 b. One dollar and fifty cents for each additional or
13 additional renewal 6-year permit, of which the State
14 Transportation Trust Fund shall receive all funds collected.
15 c. Fifteen dollars for each initial 4-year permit or
16 renewal permit, of which the State Transportation Trust Fund
17 shall receive $13.50 and the tax collector of the county in
18 which the fee was collected shall receive $1.50.
19 d. One dollar for each additional or additional
20 renewal 4-year permit, of which the State Transportation Trust
21 Fund shall receive all funds collected.

23 The department shall not issue an additional disabled parking
24 permit upon request of an eligible applicant unless the
25 applicant states that they are a frequent traveler or a
26 quadriplegic. The department may not issue to any one
27 eligible applicant more than two disabled parking permits
28 except to an organization in accordance with paragraph (1)(d).
29 Subsections (1), (5), (6), and (7) apply to this subsection.
30 2. If an applicant who is a disabled veteran, is a
31 resident of this state, has been honorably discharged, and

1 either has been determined by the Department of Defense or the
2 United States Department of Veterans Affairs Veterans
3 Administration of the Federal Government to have a
4 service-connected disability rating for compensation of 50
5 percent or greater or has been determined to have a
6 service-connected disability rating of 50 percent or greater
7 and is in receipt of both disability retirement pay from the
8 United States Department of Veterans Affairs Veterans
9 Administration and has a signed physician's statement of
10 qualification for the disabled parking permits, the fee for a
11 disabled parking permit shall be:
12 a. Two dollars and twenty-five cents for the initial
13 6-year permit or renewal permit.
14 b. One dollar and fifty cents for the additional or
15 additional renewal 6-year permit.
16 c. One dollar and fifty cents for the initial 4-year
17 permit or renewal permit.
18 d. One dollar for each additional or additional
19 renewal 4-year permit.

21 The tax collector of the county in which the fee was collected
22 shall retain all funds received pursuant to this subparagraph.
23 3. If an applicant presents to the department a
24 statement from the Federal Government or the State of Florida
25 indicating the applicant is a recipient of supplemental
26 security income, the fee for the disabled parking permit shall
27 be $12.75:
28 a. Twelve dollars and seventy-five cents for the
29 initial 6-year permit or renewal permit, of which the State
30 Transportation Trust Fund shall receive $10.15 and the tax
31 collector of the county in which the fee was collected shall

1 receive $2.60.
2 b. Nine dollars for the initial 4-year permit or
3 renewal permit, of which the State Transportation Trust Fund
4 shall receive $6.75 and the tax collector of the county in
5 which the fee was collected shall receive $2.25.

7 The department may not issue to any one eligible applicant
8 more than two disabled parking permits except to an
9 organization in accordance with paragraph (1)(d). Subsections
10 (1), (5), (6), and (7) apply to this subsection.
11 (3) DISABLED PARKING PERMIT; TEMPORARY.--
12 (a) The temporary disabled parking permit is a placard
13 of a different color from the color of the long-term permanent
14 disabled parking permit placard, and must clearly display the
15 date of expiration, but is in all other respects identical to
16 the long-term permanent disabled parking permit placard. The
17 temporary disabled parking permit placard must be designed to
18 conspicuously display the expiration date of the permit on the
19 front and back of the placard.
20 Section 29. Except as otherwise provided herein, this
21 act shall take effect October 1, 1997.
