1 A bill to be entitled
2 An act relating to state government; providing
3 legislative intent; providing duties of
4 procuring agencies relating to procurement
5 contracts; imposing certain duties on the
6 Comptroller; providing application; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. It is the intent of the Legislature that
12 the Comptroller have access to and annually publish the amount
13 of dollars spent by this state in the labor portion of
14 state-contracted services to serve as a benchmark and
15 measurement tool of state-contracted employment.
16 (1) As a condition of each procurement contract in
17 excess of the threshold amount provided in section 287.017,
18 Florida Statutes, for CATEGORY FOUR entered into after
19 December 31, 1998, the procuring agency shall require the
20 successful contractor to provide estimates of the number of
21 full-time-equivalent positions, or fractions thereof, and the
22 amount of dollars represented by the labor portion, including
23 salary and benefits, of each contract. The procuring agency
24 shall record such estimates in the State Automated Management
25 Accounting Subsystem in accordance with procedures prescribed
26 by the Comptroller.
27 (2) The Comptroller shall include in the State
28 Automated Management Accounting Subsystem the capability to
29 prepare reports containing the estimates of the number of
30 full-time-equivalent positions and labor dollars for contracts

1 entered into the system by agencies after December 31, 1998.
2 The Comptroller shall publish such information annually.
3 (3) This section does not apply to contracts for the
4 purchase of commodities as defined in section 287.012, Florida
5 Statutes, but applies to all other contracts entered into by
6 the state, including, but not limited to, contracts for social
7 services, road design and construction, building construction,
8 management consulting services, and public-private
9 partnerships.
10 Section 2. This act shall take effect upon becoming a
11 law.

14 LEGISLATIVE SUMMARY
15 Requires procuring agencies to require contractors to
provide estimates of positions and moneys under the labor
16 portion of procurement contracts. Requires procuring
agencies to record such information in the State
17 Automated Management Accounting Subsystem. Requires the
Comptroller to include in the State Automated Management
18 Accounting Subsystem the capability to prepare reports of
such information and to publish the information annually.
