  1                      A bill to be entitled

  2         An act relating to concurrency on the Florida

  3         Interstate Highway System; amending s.

  4         163.3180, F.S.; directing the Department of

  5         Transportation to lower the level-of-service

  6         standard on certain segments of the system

  7         within the jurisdiction of a local government

  8         under certain circumstances; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Subsection (10) of section 163.3180,

14  Florida Statutes, is amended to read:

15         163.3180  Concurrency.--

16         (10)(a)  With regard to facilities on the Florida

17  Intrastate Highway System as defined in s. 338.001, local

18  governments shall adopt the level-of-service standard

19  established by the Department of Transportation by rule.  For

20  all other roads on the State Highway System, local governments

21  shall establish an adequate level-of-service standard that

22  need not be consistent with any level-of-service standard

23  established by the Department of Transportation.

24         (b)  At the request of local government, the Department

25  of Transportation shall lower the level-of-service standard

26  one letter grade on any segment of the Florida Interstate

27  Highway System which is within the requesting local

28  government's jurisdiction if:

29         1.  The road segment is required to meet a B

30  level-of-service standard under Department of Transportation

31  rules; and

  1         2.  At least 50 percent of the traffic using the road

  2  segment passes directly through the local government's

  3  jurisdiction.

  4         Section 2.  This act shall take effect upon becoming a

  5  law.

  8                       LEGISLATIVE SUMMARY

      Provides that, at the request of local government, the
10    Department of Transportation shall lower the
      level-of-service standard one letter grade on any segment
11    of the Florida Interstate Highway System which is within
      the requesting local government's jurisdiction under
12    described circumstances. (See bill for details.)
