2 An act relating to health insurance; amending
3 s. 627.419, F.S.; including physician
4 assistants within certain benefits or services
5 payment provisions; limiting application;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (6) of section 627.419, Florida
11 Statutes, 1996 Supplement, is amended to read:
12 627.419 Construction of policies.--
13 (6) Notwithstanding any other provision of law, when
14 any health insurance policy, health care services plan, or
15 other contract provides for payment for surgical first
16 assisting benefits or services, the policy, plan, or contract
17 is to be construed as providing for payment to a registered
18 nurse first assistant or employers of a physician assistant or
19 nurse first assistant who performs such services that are
20 within the scope of a physician assistant's or a registered
21 nurse first assistant's professional license. The provisions
22 of this subsection apply only if reimbursement for an
23 assisting physician, licensed under chapter 458 or chapter
24 459, would be covered and a physician assistant or a
25 registered nurse first assistant who performs such services is
26 used as a substitute.
27 Section 2. This act shall take effect October 1, 1997.
