2 An act relating to certified nursing
3 assistants; amending s. 400.211, F.S.;
4 providing that nursing assistants who work in
5 nursing home facilities are subject to federal
6 criminal records checks by the Federal Bureau
7 of Investigation as part of certification
8 requirements; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (5) of section 400.211, Florida
13 Statutes, is amended to read:
14 400.211 Persons employed as nursing assistants;
15 certification requirement.--
16 (5)(a) Every certified nursing assistant hired by a
17 nursing home facility on or after October 1, 1993, must,
18 within 5 working days after starting employment at a nursing
19 home facility, submit to the facility a complete set of
20 information necessary to conduct a records check through the
21 central abuse registry under chapter 415 and a statewide
22 criminal records correspondence check through the Department
23 of Law Enforcement. The facility shall submit the information
24 provided by the employee, within 48 hours, to the Department
25 of Children and Family Health and Rehabilitative Services'
26 central abuse registry and to the Department of Law
27 Enforcement, which shall conduct a screening according to the
28 provisions of s. 400.497(2).
29 (b) Every certified nursing assistant who is hired by
30 a nursing home facility on or after October 1, 1998, is
31 subject to a federal criminal records check conducted by the

1 Federal Bureau of Investigation and must, within 5 working
2 days after starting employment at a nursing home facility,
3 submit to the facility a complete set of information necessary
4 to conduct such a federal criminal records check. The facility
5 shall submit the information provided by the employee, within
6 48 hours, to the Federal Bureau of Investigation. The
7 requirement set forth in this paragraph is in addition to
8 other requirements for the certification of nursing
9 assistants.
10 Section 2. This act shall take effect October 1, 1998.
