1 A bill to be entitled
2 An act relating to traffic offenses; amending
3 s. 318.18, F.S.; limiting the amount for court
4 costs imposed for noncriminal traffic offenses;
5 specifying what constitutes court costs;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (11) of section 318.18, Florida
11 Statutes, is amended to read:
12 318.18 Amount of civil penalties.--The penalties
13 required for a noncriminal disposition pursuant to s. 318.14
14 are as follows:
15 (11) The court costs for noncriminal traffic
16 infractions are in addition to any fines imposed under chapter
17 316 or this chapter. The total amount of those court costs
18 must not exceed $30, and the court costs must be collected in
19 the following order of priority:
20 (a) Costs that must be imposed under this subsection,
21 which include:
22 1. Three dollars for an infraction of pedestrian
23 regulations;
24 2. Six dollars for a nonmoving traffic infraction; or
25 3. Ten dollars for a moving traffic infraction;
26 (b) Any court costs imposed in accordance with chapter
27 938;
28 (c) Costs imposed for a regional criminal justice
29 assessment center or other local criminal justice access and
30 assessment center; and

1 (d) Any other costs that the local circuit is
2 authorized to impose. (a) Court costs which are to be in
3 addition to the stated fine shall be imposed by the court in
4 an amount not less than the following:

6 For pedestrian infractions................................$ 3.
7 For nonmoving traffic infractions.........................$ 6.
8 For moving traffic infractions............................$10.
9 (b) In addition to the court cost assessed under
10 paragraph (a), the court shall impose a $3 court cost for each
11 infraction to be distributed as provided in s. 943.25(3).

13 In no event may court costs imposed under this subsection
14 exceed $30. A regional criminal justice assessment center or
15 other local criminal justice access and assessment center may
16 be funded from these court costs.
17 Section 2. This act shall take effect July 1, 1998.

for a noncriminal traffic offense is $30. Specifies what
