  1                      A bill to be entitled

  2         An act relating to prison inmates; amending s.

  3         440.15, F.S.; providing that workers'

  4         compensation benefits for inmates are payable

  5         to the state; prohibiting inmates from

  6         receiving public assistance benefits; providing

  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (9) of section 440.15, Florida

12  Statutes, is amended to read:

13         440.15  Compensation for disability.--Compensation for

14  disability shall be paid to the employee, subject to the

15  limits provided in s. 440.12(2), as follows:

16         (9)  EMPLOYEE BECOMES INMATE OF INSTITUTION.--If In

17  case an employee becomes an inmate of a public institution,

18  then no compensation shall be payable to this state unless she

19  or he has dependent upon her or him for support a person or

20  persons defined as dependents elsewhere in this chapter, whose

21  dependency shall be determined as if the employee were

22  deceased and to whom compensation would be paid in case of

23  death; and such compensation as is due such employee shall be

24  paid such dependents during the time she or he remains such

25  inmate.

26         Section 2.  All public benefits provided to a person in

27  this state shall be terminated immediately when that person

28  becomes an inmate in any prison or other correctional

29  institution. This section does not apply to workers'

30  compensation benefits required under section 946.006(4),

31  Florida Statutes.
