23 the respective universities to erect suitable
24 markers; amending s. 240.605, F.S.; renaming
25 the Florida Resident Access Grant Program as
26 the William L. Boyd, IV, Florida Resident
27 Access Grant Program; designating the
28 Children's Medical Services Clinic of St. Lucie
29 County as the "Dr. William R. Dannahower
30 Building"; authorizing the Department of Health
31 to erect suitable markers; designating the

3 "Woodrow 'Woody' Darden Building"; authorizing

7 Be It Enacted by the Legislature of the State of Florida:
8
9 Section 1. The tennis court complex at the University
10 of West Florida is hereby designated the "Harold 'Skeeter'
11 Carson Tennis Complex" in honor of the university's first
12 tennis coach and his untiring and extraordinary contribution
13 to the community and to his profession.
14 Section 2. The Lifelong Learning Center on the Boca
15 Raton Campus of Florida Atlantic University, the first
16 lifelong learning center to be constructed on any of the
17 university's seven campuses for use by the Lifelong Learning
18 Society, is hereby designated the "Barry and Florence
19 Friedberg Lifelong Learning Center" in recognition of the
20 generosity, dedication, and active support of Barry and
21 Florence Friedberg.
22 Section 3. The swim/dive office and training facility
23 at the University of Florida is hereby designated the "Wayne
24 and Jimmie Carse Swimming and Diving Complex" in recognition
25 of the generosity of Wayne and Jimmie Carse to the university
26 and its students.
27 Section 4. Flint Hall at the University of Florida is
28 hereby renamed "Keene-Flint Hall" in recognition of Kenneth K.
29 Keene's generosity to the university and its students.
30 Section 5. The residence currently known as 2nd Court,
31 Pei Residence Halls, located on the Sarasota/Manatee Campus of

1 New College of the University of South Florida, is hereby
2 designated the "Peggy Bates Residence Hall" in recognition of
3 the tireless and dedicated services of Dr. Margaret L. Bates
4 to New College and the Sarasota/Manatee community.
5 Section 6. The library tower located on the campus of
6 Florida International University is hereby designated the
7 "Steven and Dorothea Green Library" in recognition of the
8 generosity of Steven and Dorothea Green to the university
9 libraries and to the Art Museum.
10 Section 7. The recording facility donated to Florida
11 State University by Echelon International Development
12 Corporation is hereby designated "Critchfield Hall" in
13 recognition of Dr. Jack Critchfield's generosity to Florida
14 State University and his many personal, professional, and
15 philanthropic contributions to the State of Florida.
16 Section 8. The respective universities are authorized
17 to erect suitable markers for the designations made by this
18 act.
19 Section 9. Section 240.605, Florida Statutes, is
20 amended to read:
21 240.605 The William L. Boyd, IV, Florida resident
22 access grants.--
23 (1) The Legislature finds and declares that
24 independent nonprofit colleges and universities eligible to
25 participate in the William L. Boyd, IV, Florida Resident
26 Access Grant Program are an integral part of the higher
27 education system in this state and that a significant number
28 of state residents choose this form of higher education. The
29 Legislature further finds that a strong and viable system of
30 independent nonprofit colleges and universities reduces the
31 tax burden on the citizens of the state. Because the William

1 L. Boyd, IV, Florida Resident Access Grant Program is not
2 related to a student's financial need or other criteria upon
3 which financial aid programs are based, it is the intent of
4 the Legislature that the William L. Boyd, IV, Florida Resident
5 Access Grant Program not be considered a financial aid program
6 but rather a tuition assistance program for its citizens.
7 (2) The William L. Boyd, IV, Florida Resident Access
8 Grant Program shall be administered by the Department of
9 Education. The State Board of Education shall adopt rules for
10 the administration of the program.
11 (3) The department shall issue through the program a
12 William L. Boyd, IV, Florida resident access grant to any
13 full-time degree-seeking undergraduate student registered at
14 an independent nonprofit college or university which is
15 located in and chartered by the state; which is accredited by
16 the Commission on Colleges of the Southern Association of
17 Colleges and Schools; which grants baccalaureate degrees;
18 which is not a state university or state community college;
19 and which has a secular purpose, so long as the receipt of
20 state aid by students at the institution would not have the
21 primary effect of advancing or impeding religion or result in
22 an excessive entanglement between the state and any religious
23 sect. Any independent college or university that was eligible
24 to receive tuition vouchers on January 1, 1989, and which
25 continues to meet the criteria under which its eligibility was
26 established, shall remain eligible to receive William L. Boyd,
27 IV, Florida resident access grant payments.
28 (4) A person is eligible to receive such William L.
29 Boyd, IV, Florida resident access grant if:

1 (a) He or she meets the general requirements,
2 including residency, for student eligibility as provided in s.
3 240.404, except as otherwise provided in this section; and
4 (b)1. He or she is enrolled as a full-time
5 undergraduate student at an eligible college or university;
6 2. He or she is not enrolled in a program of study
7 leading to a degree in theology or divinity; and
8 3. He or she is making satisfactory academic progress
9 as defined by the college or university in which he or she is
10 enrolled.
11 (5)(a) Funding for the William L. Boyd, IV, Florida
12 Resident Access Grant Program shall be based on a formula
13 composed of planned enrollment and the state cost of funding
14 undergraduate enrollment at public institutions pursuant to s.
15 240.271. However, the amount of the William L. Boyd, IV,
16 Florida resident access grant issued to a full-time student
17 shall be 30 percent in 1996-1997, 35 percent in 1997-1998, and
18 40 percent in 1998-1999 and thereafter of the full cost to the
19 state per academic year of an undergraduate student in public
20 postsecondary education established pursuant to s. 240.209 or
21 an amount as specified in the General Appropriations Act. The
22 William L. Boyd, IV, Florida resident access grant may be paid
23 on a prorated basis in advance of the registration period. The
24 department shall make such payments to the college or
25 university in which the student is enrolled for credit to the
26 student's account for payment of tuition and fees.
27 Institutions shall certify to the department the amount of
28 funds disbursed to each student and shall remit to the
29 department any undisbursed advances or refunds within 60 days
30 of the end of regular registration. Students shall not be

1 eligible to receive the award for more than 9 semesters or 14
2 quarters, except as otherwise provided in s. 240.404(3).
3 (b) If the combined amount of the William L. Boyd, IV,
4 Florida resident access grant issued pursuant to this act and
5 all other scholarships and grants for tuition or fees exceeds
6 the amount charged to the student for tuition and fees, the
7 department shall reduce the William L. Boyd, IV, Florida
8 resident access grant issued pursuant to this act by an amount
9 equal to such excess.
10 (c) For the 1997-1998 fiscal year only, funding for
11 the William L. Boyd, IV, Florida resident access grant shall
12 be the amount set forth in the General Appropriations Act.
13 This paragraph is repealed on July 1, 1998.
14 Section 10. Dr. William R. Dannahower Building
15 designated; markers.--
16 (1) The Children's Medical Services Clinic of St.
17 Lucie County is hereby designated the "Dr. William R.
18 Dannahower Building."
19 (2) The Department of Health is authorized to erect
20 suitable markers designating the Dr. William R. Dannahower
21 Building as described in subsection (1).
22 Section 11. The Regional Office of the Florida Game
23 and Fresh Water Fish Commission located at 8535 Northlake
24 Boulevard in West Palm Beach, Florida is designated as the
25 "Woodrow 'Woody' Darden Building." The Game and Fresh Water
26 Fish Commission is authorized to erect suitable markers
27 designating this building.
28 Section 12. This act shall take effect upon becoming a
29 law.
