11  Senator Grant moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 6, between lines 24 and 25,

15

16  insert:

17         Section 3.  Section 240.136, Florida Statutes, is

18  created to read:

19         240.136 Suspension and removal from office of elected

20  student government officials; referendum.--Each state

21  university and community college student government

22  association shall establish a process within 60 days after

23  this act becomes law to provide for the removal from office of

24  any elected student government official who has been convicted

25  of a violation of criminal law or has been found civilly

26  liable for an act of moral turpitude, after all available

27  rights of judicial appeal have been exercised or waived or

28  have expired. The process must include a procedure for the

29  immediate suspension of the student government official from

30  elective office following the conviction or civil finding and

31  during any appeal, and must provide for the temporary

 1  successor to the office pending completion of any appeal. The

 2  process must also include a procedure for registered students

 3  to petition for a referendum recommending to the student

 4  government association the removal of the student official

 5  from elective office. The referendum must be held within 60

 6  days after the filing of the petition. The recommendation to

 7  remove the official from elective office must be made by

 8  majority vote of the students participating in the referendum.

 9  The action of the student government association under this

10  section shall be subject to an appeal to the university

11  president or his or her designee.

21         creating s. 240.136, F.S.; requiring the
