17 Section 17. Paragraph (b) of subsection (1) of section
18 288.904, Florida Statutes, is amended to read:
19 288.904 Powers of the board of directors of Enterprise
20 Florida, Inc.--
21 (1) The board of directors of Enterprise Florida,
22 Inc., shall have the power to:
23 (b) Make and enter into contracts and other
24 instruments necessary or convenient for the exercise of its
25 powers and functions, except that no any contract may be made
26 with an organization represented on the nominating council or
27 on the board of directors of Enterprise Florida, Inc., or on
28 the board of directors of any of its affiliate boards. must be
29 approved by a two-thirds vote of the entire board of
30 directors, and the board member representing such organization
31 shall abstain from voting. No more than 65 percent of the

1 dollar value of all contracts or other agreements entered into

4 the board of directors. An organization represented on the
5 board of directors of Enterprise Florida, Inc., or on the
6 board of directors of any of its affiliate boards or on the
7 nominating council may not enter into a contract to receive a
8 state-funded economic development incentive or similar grant.,
9 unless such incentive award is specifically endorsed by a
10 two-thirds vote of the entire board. The board member
11 representing such organization, if applicable, shall abstain
12 from voting and refrain from discussing the issue with other
13 members of the board. No more than 50 percent of the dollar
14 value of grants issued by the board in any fiscal year may go
15 to businesses associated with board members.
16 Section 18. Paragraph (g) of subsection (1) of section
17 288.9414, Florida Statutes, is amended to read:
18 288.9414 Powers and authority of board of directors of
19 International Trade and Economic Development Board.--
20 (1) The board shall have all the powers and authority
21 not explicitly prohibited by statute necessary or convenient
22 to carry out and effectuate its functions, duties, and
23 responsibilities, including, but not limited to:
24 (g) Contracting with public and private entities as
25 necessary to further the directives of this act, except that
26 no any contract may be made with an organization represented
27 on the nominating council or on the board of directors of
28 Enterprise Florida, Inc., or on the board of directors of any
29 of its affiliate boards. must be approved by a two-thirds vote
30 of the entire board of directors, and the board member
31 representing such organization shall abstain from voting. No

21 purposes stated in s. 288.9512 through technology application,
22 technology commercialization, and technology development, as
23 well as other activities related to building a competitive,
24 knowledge-based economy. The board shall have all the powers
25 and authority not explicitly prohibited by statute necessary
26 or convenient to carry out and effectuate its functions,
27 duties, and responsibilities, including, but not limited to:
28 (h) Contracting with public and private entities as
29 necessary to further the directives of this act, except that
30 no any contract may be made with an organization represented
31 on the nominating council or on the board of directors of

27 the purposes of this act, as well as the functions, duties,
28 and responsibilities of the board, including, but not limited
29 to, the following:
