  1                      A bill to be entitled

  2         An act relating to drivers' licenses; amending

  3         s. 322.34, F.S.; specifying what constitutes

  4         knowledge, for purposes of determining whether

  5         a person has committed the crime of driving

  6         with a drivers' license that has been

  7         suspended, canceled, or revoked; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (2) of section 322.34, Florida

13  Statutes, is amended to read:

14         322.34  Driving while license suspended, revoked,

15  canceled, or disqualified.--

16         (2)  Any person whose driver's license or driving

17  privilege has been canceled, suspended, or revoked as provided

18  by law, except persons defined in s. 322.264, who, knowing of

19  such cancellation, suspension, or revocation, drives any motor

20  vehicle upon the highways of this state while such license or

21  privilege is canceled, suspended, or revoked, upon:

22         (a)  A first conviction is guilty of a misdemeanor of

23  the second degree, punishable as provided in s. 775.082 or s.

24  775.083.

25         (b)  A second conviction is guilty of a misdemeanor of

26  the first degree, punishable as provided in s. 775.082 or s.

27  775.083.

28         (c)  A third or subsequent conviction is guilty of a

29  felony of the third degree, punishable as provided in s.

30  775.082, s. 775.083, or s. 775.084.

  1  The element of knowledge is satisfied if the person has been

  2  previously cited as provided in subsection (1); or the person

  3  admits to knowledge of the cancellation, suspension, or

  4  revocation; or the person received notice as provided in

  5  subsection (4) or s. 322.251.

  6         Section 2.  This act shall take effect July 1, 1998.

  9                          SENATE SUMMARY

10    Provides that a person whose driver's license has been
      canceled, suspended, or revoked and who drives a vehicle
11    on the public highways has done so knowingly if that
      person received notice as provided in s. 322.251, F.S.
