Florida House of Representatives - 1997 HB 799 By Representative Fischer 1 A bill to be entitled 2 An act relating to ballots; amending s. 3 101.5609, F.S.; requiring the page or series of 4 pages of a ballot information booklet relating 5 to presidential races to be separate from all 6 other candidacies, proposals, public measures, 7 and propositions; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsections (2) and (3) of section 12 101.5609, Florida Statutes, 1996 Supplement, are amended to 13 read: 14 101.5609 Ballot requirements.-- 15 (2) Except as otherwise provided in subsection (3), 16 the ballot information shall, as far as practicable, be in the 17 order of arrangement provided for paper ballots. Ballots for 18 all questions or propositions to be voted on shall be provided 19 in the same manner and shall be arranged on or in the voting 20 device, if necessary, in the places provided for such 21 purposes. 22 (3) When an electronic voting system utilizes a ballot 23 information booklet for candidates and propositions to be 24 voted upon, such ballot information may be provided with a 25 series of pages distinguished by different colors. More than 26 one public measure or proposition may be placed on the same 27 page or series of pages. However, with respect to ballot 28 information on candidates, the category reserved for 29 candidates for President and Vice President must appear on the 30 same page or series of pages, and no other candidate, category 31 of candidates, or proposal, public measure, or proposition may 1 CODING: Words stricken are deletions; words underlined are additions. The supervisor of elections may 2 complete the ballot information booklet with categories of 3 candidates out of proper sequence, but only if and to the 4 extent necessary to segregate the presidential races as 5 required by this subsection. 6 Section 2.
