1 A bill to be entitled
2 An act relating to the health of inmates in the
3 state correctional system; amending s. 944.09,
4 F.S.; requiring that the Department of
5 Corrections adopt rules for monitoring the
6 purchases made by inmates from the commissary
7 or canteen; requiring the department to
8 prohibit an inmate from purchasing items that
9 are contrary to a restricted diet prescribed by
10 a physician; requiring that the department add
11 additional time to an inmate's sentence if an
12 inmate makes a prohibited purchase; providing
13 an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Present paragraph (r) of subsection (1) of
18 section 944.09, Florida Statutes, is redesignated as paragraph
19 (s), and a new paragraph (r) is added to that subsection to
20 read:
21 944.09 Rules of the department; offenders,
22 probationers, and parolees.--
23 (1) The department shall adopt rules governing the
24 administration of the correctional system and the operation of
25 the department, which rules shall relate to:
26 (r) The purchase of items from the commissary or
27 canteen by inmates. The department shall prohibit an inmate
28 from purchasing items from the commissary or canteen which are
29 contrary to any restricted or therapeutic diet prescribed for
30 that inmate by a physician and which may risk the health of
31 the inmate. Purchases that may be prohibited include, but need

1 not be limited to, candy, chocolate, tobacco, and other food
2 or nonfood items. The department shall monitor the purchases
3 made by each inmate for whom a restricted or therapeutic diet
4 is prescribed. If an inmate makes a prohibited purchase, the
5 department shall add an additional 100 days to the inmate's
6 sentence.
7 Section 2. This act shall take effect July 1, 1998.

10 SENATE SUMMARY
11 Requires that the Department of Corrections adopt rules
governing purchases made by inmates from the commissary
12 or canteen. Requires that an inmate be prohibited from
purchasing items that are contrary to a diet prescribed
13 by a physician. Requires that the department monitor the
purchases made by any inmate on a restricted diet.
14 Requires that the department add an additional 100 days
to an inmate's sentence if the inmate makes a prohibited
15 purchase.
