2 An act relating to state lotteries; requiring
3 the Department of the Lottery to conduct a
4 special lottery pilot program for the
5 enhancement of postsecondary education;
6 providing for deposit, distribution, and use of
7 proceeds; authorizing rules; requiring
8 recommendations; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. (1) The Department of the Lottery shall
13 develop and conduct, in addition to the lotteries operated
14 pursuant to chapter 24, Florida Statutes, a 3-year special
15 lottery pilot program for the enhancement of postsecondary
16 education in the state. The pilot program shall consist of a
17 lottery game to be conducted on the third Friday of each
18 month. After payment of prizes and compensation to retailers,
19 proceeds of the lottery game shall be deposited in a separate
20 account in the Administrative Trust Fund, pursuant to s.
21 24.120, Florida Statutes, and shall be transferred to the
22 Department of Education for distribution to state universities
23 and community colleges. Funds shall be distributed each month
24 to a state university or community college as determined by
25 the Board of Regents or State Board of Community Colleges,
26 provided that each of the ten state universities shall be
27 selected to receive funds once a year and two community
28 colleges per year shall be selected to receive funds. If a
29 prize winner is not determined at the monthly drawing, the
30 game shall roll over to the following month until a winner is

1 determined, and the proceeds shall be divided among the
2 designated institutions.
3 (2) Funds must be used by the postsecondary
4 institution to provide merit scholarships to students, with
5 eligibility standards established by the Board of Regents or
6 the State Board of Community Colleges.
7 (3) The department shall develop this special lottery
8 pilot program in such a manner as not only to have the least
9 negative impact on the existing state lotteries, but also to
10 provide the maximum revenues for the enhancement of
11 postsecondary education.
12 (4) The department may adopt rules to implement the
13 provisions of this act.
14 (5) The department shall conduct a review of the
15 special lottery pilot program after the second year of
16 operation and provide recommendations to the President of the
17 Senate and the Speaker of the House of Representatives
18 regarding extension, expansion, or termination of the program.
19 Section 2. This act shall take effect October 1, 1997.
