  1                      A bill to be entitled

  2         An act relating to traffic infractions;

  3         amending s. 318.121, F.S., relating to

  4         preemption of additional fees, fines,

  5         surcharges, and costs for traffic infractions;

  6         providing an exception from preemption with

  7         respect to such additional fees, fines,

  8         surcharges, and costs authorized under

  9         provisions of a general or special law or

10         municipal or county ordinance which establish

11         or fund a regional criminal justice assessment

12         center or other local criminal justice access

13         and assessment center; providing an effective

14         date.

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  Section 318.121, Florida Statutes, 1996

19  Supplement, is amended to read:

20         318.121  Preemption of additional fees, fines,

21  surcharges, and costs.--Notwithstanding any general or special

22  law, or municipal or county ordinance, additional fees, fines,

23  surcharges, or costs other than the court costs assessed under

24  s. 318.18(11) may not be added to the civil traffic penalties

25  assessed in this chapter.  However, this section shall not be

26  construed to preempt such additional fees, fines, surcharges,

27  or costs authorized under the provisions of a general or

28  special law or of a municipal or county ordinance which

29  establish or provide for the funding of a regional criminal

30  justice assessment center or other local criminal justice

31  access and assessment center.

  1         Section 2.  This act shall take effect upon becoming a

  2  law.

      Provides that certain provisions for preemption of

      traffic infractions do not apply to preempt such fees,
  8    fines, surcharges, and costs authorized under provisions

      justice assessment center or other local criminal justice
