Florida House of Representatives - 1997 CS/HB 815 By the Committee on Governmental Operations and Representative Wallace 1 A bill to be entitled 2 An act relating to state government; providing 3 legislative intent; providing duties of 4 procuring agencies relating to procurement 5 contracts; imposing certain duties on the 6 Comptroller; providing application; providing 7 an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. It is the intent of the Legislature that 12 the Comptroller shall have access to and annually publish the 13 amount of dollars spent by this state in the labor portion of 14 state contracted services to serve as a benchmark and 15 measurement tool of state contracted employment. 16 (1) As a condition of each procurement contract in 17 excess of the threshold amount provided in s. 287.017, Florida 18 Statutes, for CATEGORY FOUR entered into after December 31, 19 1997, the procuring agency shall require the successful 20 contractor to provide estimates of the number of full-time 21 equivalent positions, or fractions thereof, and the amount of 22 dollars represented by the labor portion, including salary and 23 benefits, of each contract. The procuring agency shall record 24 such estimates in the State Automated Management Accounting 25 Subsystem in accordance with procedures prescribed by the 26 Comptroller. 27 (2) The Comptroller shall include in the State 28 Automated Management Accounting Subsystem the capability to 29 prepare reports containing the estimates of the number of 30 full-time equivalent positions and labor dollars for contracts 31 1 CODING: Words stricken are deletions; words underlined are additions. This section shall apply to all other contracts 6 entered into by the state, including, but not limited to, 7 contracts for social services, road design and construction, 8 building construction, management consulting services, and 9 public-private partnerships. 10 Section 2. This action shall take effect upon becoming 11 a law. 12 13 ***************************************** 14 HOUSE SUMMARY 15 Requires procuring agencies to require contractors to 16 provide estimates of positions and money under the labor portion of procurement contracts. Requires procuring 17 agencies to record such information in the State Automated Management Accounting Subsystem. Requires the 18 Comptroller to include in the State Automated Management Accounting Subsystem the capability to prepare reports of 19 such information and to publish the information annually.
