14         On page 2, line 1, through page 4, line 5, delete those

15  lines

17  and insert:

18         Section 1.  Paragraphs (c) and (d) of subsection (3) of

19  section 20.43, Florida Statutes, 1996 Supplement, are amended,

20  present paragraph (f) of that subsection is redesignated as

21  paragraph (g), and a new paragraph (f) is added to that

22  subsection; and subsections (6) and (7) are added to that

23  section, to read:

24         20.43  Department of Health.--There is created a

25  Department of Health.

26         (3)  The following divisions of the Department of

27  Health are established:

28         (c)  Division of Disease Intervention Control.

29         (d)  Division of Family Health Services.

30         (f)  Division of Local Health Planning, Education, and

31  Workforce Development.

  1         (6)  To protect and improve the public health, the

  2  department may use state or federal funds to:

  3         (a)  Provide incentives, including food coupons or

  4  payment for travel expenses, for encouraging disease

  5  prevention and patient compliance with medical treatment, such

  6  as tuberculosis therapy.

  7         (b)  Plan and conduct health education campaigns for

  8  the purpose of protecting or improving public health. The

  9  department may purchase promotional items and advertising,

10  such as space on billboards or in publications or radio or

11  television time, for health information and promotional

12  messages.

13         (c)  Plan and conduct promotional campaigns to recruit

14  health professionals to be employed by the department or to

15  recruit participants in departmental programs for health

16  practitioners, such as scholarship, loan repayment, or

17  volunteer programs. To this effect the department may purchase

18  promotional items and advertising.

19         (7)(a)  In accordance with chapter 216, 20 percent of

20  any unobligated general revenue or trust fund appropriation

21  for salaries and benefits, expenses, other personal services,

22  operating capital outlay, and special categories remaining at

23  the end of a fiscal year shall be available to the department

24  for purchases of productivity-enhancing technology, improving

25  existing services, and community health initiatives. Funds

26  used for such purposes may be certified forward. The

27  department shall have until June 30, 1998 to make reversions

28  from the 1996-1997 budget.

29         (b)  The secretary may transfer funds, positions, and

30  budget authority within the department pursuant to chapter

31  216, provided the department comports generally with

  1  legislative intent.

  2         (c)  The secretary may transfer salary rate within the

  3  department with the prior approval of the Executive Office of

  4  the Governor and in accordance with chapter 216.

  5         (d)  The secretary may establish or abolish offices and

  6  may allocate duties and functions within the department unless

  7  such offices, duties, and functions are otherwise prescribed

  8  in law.  Administrative services may be delivered at the

  9  county health department, institutional, or higher level, as

10  determined by the secretary to achieve the greatest efficiency

11  and cost-effectiveness.

12         (e)  The secretary is authorized to transfer up to 0.5

13  percent of the total department budget in order to establish

14  positions in excess of those authorized for administrative

15  support and contract management pursuant to the budget

16  amendment provisions of chapter 216.

17         Section 2.  Paragraph (c) of subsection (6) of section

18  110.131, Florida Statutes, 1996 Supplement, is amended to

19  read:

20         110.131  Other-personal-services temporary

21  employment.--

22         (6)

23         (c)  Notwithstanding the provisions of this section,

24  the secretary of the Department of Health and Rehabilitative

25  Services or the secretary's delegate may extend the

26  other-personal-services employment of a health care

27  practitioner licensed pursuant to chapter 458, chapter 459,

28  chapter 460, chapter 461, chapter 463, chapter 464, chapter

29  466, chapter 468, chapter 483, chapter 486, or chapter 490

30  beyond 2,080 hours and may employ such practitioner on an

31  hourly or other basis.

  1         Section 3.  Subsection (6) of section 216.0172, Florida

  2  Statutes, 1996 Supplement, is amended to read:

  3         216.0172  Schedule for submission of performance-based

  4  program budgets.--In order to implement the provisions of

  5  chapter 94-249, Laws of Florida, state agencies shall submit

  6  performance-based program budgets for programs approved

  7  pursuant to s. 216.0166 to the Executive Office of the

  8  Governor and the Legislature based on the following schedule:

  9         (6)  By September 1, 1999, for the 2000-2001 fiscal

10  year, by the following:

11         (a)  Division of Administrative Hearings.

12         (b)  Department of Business and Professional

13  Regulation.

14         (c)  Parole and Probation Commission.

15         (d)  Public Service Commission.

16         (e)  Department of Health.
