  1                      A bill to be entitled

  2         An act relating to telecommunications network

  3         access services; amending s. 364.163, F.S.;

  4         revising criteria for reducing certain access

  5         rates under certain circumstances; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsections (6) and (7) of section 364.163,

11  Florida Statutes, are amended to read:

12         364.163  Network access services.--For purposes of this

13  section, "network access service" is defined as any service

14  provided by a local exchange telecommunications company to a

15  telecommunications company certificated under this chapter or

16  licensed by the Federal Communications Commission to access

17  the local exchange telecommunications network, excluding the

18  local interconnection arrangements in s. 364.16 and the resale

19  arrangements in s. 364.161. Each local exchange

20  telecommunications company subject to s. 364.051 shall

21  maintain tariffs with the commission containing the terms,

22  conditions, and rates for each of its network access services.

23         (6)  Any local exchange telecommunications company with

24  less than 3 million basic local telecommunications service

25  access lines in service on July 1, 1995, whose current

26  intrastate switched access rates are higher than its

27  interstate switched access rates in effect on December 31,

28  1994, shall reduce its intrastate switched access rates to the

29  level in effect on March 1, 1997, for those local

30  telecommunications companies with more than 3 million basic

31  local telecommunications service access lines in service on

  1  July 1, 1995 by 5 percent annually beginning October 1, 1996.

  2  Any such company shall be relieved of this requirement if it

  3  reduces such rates by a greater percentage by the relevant

  4  date or earlier, taking into account any reduction made

  5  pursuant to Florida Public Service Commission Order No. PSC

  6  94-0172-FOF-TL.  Upon reaching parity between intrastate and

  7  1994 interstate switched access rates, no further reductions

  8  shall be required.  Any telecommunications company whose

  9  intrastate switched access rate is reduced by this subsection

10  shall decrease its customer long distance rates by the amount

11  necessary to return the benefits of such reduction to its

12  customers.

13         (7)  Telecommunications company intrastate switched

14  access and customer long distance rate reductions shall become

15  effective on July 1, 1997 October 1 of each relevant year.

16  Rate decreases proposed in tariff revisions filed by the

17  telecommunications companies with the commission shall be

18  presumed valid and become effective on July 1, 1997 October 1

19  of each relevant year.

20         Section 2.  This act shall take effect July 1, 1997.
