4 changing terminology to conform to the renaming
5 of the Violent Crime Investigative Emergency
6 Account as the Violent Crime Emergency Account
7 by ch. 94-215, Laws of Florida; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (d) of subsection (2) and
13 paragraph (b) of subsection (4) of section 943.031, Florida
14 Statutes, 1996 Supplement, are amended to read:
15 943.031 Florida Violent Crime Council.--The
16 Legislature finds that there is a need to develop and
17 implement a statewide strategy to address violent criminal
18 activity. In recognition of this need, the Florida Violent
19 Crime Council is created within the department. The council
20 shall serve in an advisory capacity to the department.
21 (2) TERMS OF MEMBERSHIP; OFFICERS; COMPENSATION;
22 STAFF.--
23 (d) Members of the council shall serve without
24 compensation but are entitled to reimbursement for per diem
25 and travel expenses pursuant to s. 112.061. Reimbursements
26 made pursuant to this paragraph shall be paid from the Violent
27 Crime Investigative Emergency Account within the Department of
28 Law Enforcement Operating Trust Fund.
29 (4) DUTIES OF COUNCIL.--The council shall provide
30 advice and make recommendations, as necessary, to the
31 executive director of the department.

1 (b) Additionally, the council shall:
2 1. Advise the executive director on the creation of
3 regional violent crime investigation coordinating teams.
4 2. Develop criteria for the disbursement of funds from
5 the Violent Crime Investigative Emergency Account within the
6 Department of Law Enforcement Operating Trust Fund.
7 3. Review and approve all requests for disbursement of
8 funds from the Violent Crime Emergency Account within the
9 Department of Law Enforcement Operating Trust Fund. An
10 expedited approval procedure shall be established for rapid
11 disbursement of funds in emergency situations.
12 4. Advise the executive director on the development of
13 a statewide violent crime information system.
14 Section 2. Subsection (1) of section 943.042, Florida
15 Statutes, is amended to read:
16 943.042 Violent Crime Emergency Account within the
17 Department of Law Enforcement Operating Trust Fund.--
18 (1) There is created a Violent Crime Investigative
19 Emergency Account within the Department of Law Enforcement
20 Operating Trust Fund. The account shall be used to provide
21 emergency supplemental funds to:
22 (a) State and local law enforcement agencies which are
23 involved in complex and lengthy violent crime investigations;
24 (b) State and local law enforcement agencies which are
25 involved in violent crime investigations which constitute a
26 significant emergency within the state; or
27 (c) Counties which demonstrate a significant hardship
28 or an inability to cover extraordinary expenses associated
29 with a violent crime trial.
30 Section 3. This act shall take effect upon becoming a
31 law.
