1 A bill to be entitled
2 An act relating to gambling equipment; creating
3 s. 849.2315, F.S.; directing the Department of
4 Business and Professional Regulation to make
5 certain rules; requiring manufacturers to be
6 bonded and to place a registration number on
7 equipment manufactured; providing for
8 administrative and criminal penalties;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 849.2315, Florida Statutes, is
14 created to read:
15 849.2315 Manufacture of certain gambling devices;
16 registration required; bond; penalties for violations.--
17 (1) The Department of Business and Professional
18 Regulation shall provide, by rule adopted within 90 days after
19 the effective date of this act, for the regulation of the
20 manufacture of gambling equipment. In addition to any other
21 requirements, such rules shall provide:
22 (a) That each piece of gambling equipment manufactured
23 in Florida be stamped with a registration number clearly
24 identifying the manufacturer of the equipment.
25 (b) That manufacturers of gambling equipment be bonded
26 in order to conduct business in Florida. The amount of the
27 bond required shall be determined by the department.
28 (c) For administrative penalties, including the loss
29 of any occupational license, when a manufacturer knowingly
30 sells gambling equipment to a person or corporation to be used
31 for illegal purposes.

1 (2) Any manufacturer who violates the provisions of
2 this section by knowingly selling gambling equipment to be
3 used by the purchaser for illegal purposes, shall, in addition
4 to any administrative penalty, upon conviction, be guilty of a
5 felony of the third degree, punishable as provided in s.
6 775.082, s. 775.083, or s. 775.085. Any person who is found
7 guilty of a second or subsequent violation of this section
8 shall be guilty of a felony of the first degree, punishable as
9 provided in s. 775.082, s. 775.083, or s. 775.084.
10 Section 2. This act shall take effect October 1, 1998.

Requires manufacturers of gambling equipment to be bonded
15 and to stamp such equipment with an identifying
registration number. Directs the Department of Business
16 and Professional Regulation to make described rules with
respect to the manufacture of such equipment. Provides
17 penalties for manufacturers who knowingly sell such
equipment which is used for illegal purposes. (See bill
