  1                      A bill to be entitled

  2         An act relating to the state lottery; amending

  3         s. 24.105, F.S., relating to player activated

  4         vending machines; requiring a certain number of

  5         clerks to be on duty at certain lottery

  6         retailer locations; amending s. 24.111, F.S.;

  7         deleting the requirement that the Department of

  8         the Lottery lease all instant vending machines

  9         for a specified initial evaluation period;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Paragraph (a) of subsection (10) of section

15  24.105, Florida Statutes, is amended to read:

16         24.105  Powers and duties of department.--The

17  department shall:

18         (10)  Adopt rules governing the establishment and

19  operation of the state lottery, including:

20         (a)  The type of lottery games to be conducted, except

21  that:

22         1.  No name of an elected official shall appear on the

23  ticket or play slip of any lottery game or on any prize or on

24  any instrument used for the payment of prizes, unless such

25  prize is in the form of a state warrant.

26         2.  No coins or currency shall be dispensed from any

27  electronic computer terminal or device used in any lottery

28  game.

29         3.  Other than as provided in subparagraph 4., no

30  terminal or device may be used for any lottery game which may

  1  be operated solely by the player without the assistance of the

  2  retailer.

  3         4.  The only player-activated machine which may be

  4  utilized is a machine which dispenses instant lottery game

  5  tickets following the insertion of a coin or currency by a

  6  ticket purchaser.  To be authorized a machine must: be under

  7  the supervision and within the direct line of sight of the

  8  lottery retailer to ensure that the machine is monitored and

  9  only operated by persons at least 18 years of age; be capable

10  of being electronically deactivated by the retailer to

11  prohibit use by persons less than 18 years of age through the

12  use of a lockout device that maintains the machine's

13  deactivation for a period of no less than 5 minutes; and be

14  designed to prevent its use or conversion for use in any

15  manner other than the dispensing of instant lottery tickets.

16  Authorized machines may dispense change to players purchasing

17  tickets but may not be utilized for paying the holders of

18  winning tickets of any kind. At least one clerk two clerks

19  must be on duty at the lottery retailer while the machine is

20  in operation. However, at least two clerks must be on duty at

21  any lottery location which has violated s. 24.1055.

22         Section 2.  Paragraph (h) of subsection (2) of section

23  24.111, Florida Statutes, is amended to read:

24         24.111  Vendors; disclosure and contract

25  requirements.--

26         (2)  The department shall investigate the financial

27  responsibility, security, and integrity of each vendor with

28  which it intends to negotiate a contract for major

29  procurement.  Such investigation may include an investigation

30  of the financial responsibility, security, and integrity of

31  any or all persons whose names and addresses are required to

  1  be disclosed pursuant to paragraph (a).  Any person who

  2  submits a bid, proposal, or offer as part of a major

  3  procurement must, at the time of submitting such bid,

  4  proposal, or offer, provide the following:

  5         (h)  The department shall lease all instant ticket

  6  vending machines for an initial evaluation period of 18

  7  months.

  9  The department shall not contract with any vendor who fails to

10  make the disclosures required by this subsection, and any

11  contract with a vendor who has failed to make the required

12  disclosures shall be unenforceable.  Any contract with any

13  vendor who does not comply with such requirements for

14  periodically updating such disclosures during the tenure of

15  such contract as may be specified in such contract may be

16  terminated by the department.  This subsection shall be

17  construed broadly and liberally to achieve the ends of full

18  disclosure of all information necessary to allow for a full

19  and complete evaluation by the department of the competence,

20  integrity, background, and character of vendors for major

21  procurements.

22         Section 3.  This act shall take effect upon becoming a

23  law.
