17         Section 1.  Section 501.926, Florida Statutes, is

18  created to read:

19         501.926  Restrictions on labeling and advertising of

20  tobacco products.--

21         (1)  No manufacturer, distributor, retailer, or agent

22  thereof may use any outdoor advertising, including, but not

23  limited to, billboards, posters, or placards, within 1,000

24  feet of any playground, elementary school, or secondary

25  school; nor shall they, under any circumstances, use other

26  than black text on a white background for outdoor advertising

27  which is otherwise permissible.

28         (2)  Permissible advertising shall contain a disclaimer

29  in printed text that is as large as the product's established

30  name in the text of the advertisement.  That disclaimer shall

31  be, as is applicable to the advertised product, "Cigarettes -

  3  appropriate for the product, followed by the words "A

  4  Nicotine-Delivery Device."

  5         (3)  Any person, firm, partnership, association,

  6  corporation, or agent thereof who violates any of the

  7  provisions of this section commits a misdemeanor of the second

  8  degree, punishable as provided in s. 775.082 or s. 775.083.

  9  Each noncomplying billboard, poster, or placard shall be a

10  separate violation.
