3 systems; amending s. 367.171, F.S.; revising
4 language with respect to the exclusive
5 jurisdiction of the Florida Public Service
6 Commission over certain utility facilities;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (7) of section 367.171, Florida
12 Statutes, 1996 Supplement, is amended to read:
13 367.171 Effectiveness of this chapter.--
14 (7) Notwithstanding anything in this section to the
15 contrary, the commission shall have exclusive jurisdiction
16 over each all utility facility that delivers water to or
17 treats wastewater from its customers in one county and
18 delivers water to or treats wastewater from that utility's
19 customers in an adjacent county through at least one pipe that
20 crosses the county boundary which separates the adjacent
21 counties systems whose service transverses county boundaries,
22 whether the counties involved are jurisdictional or
23 nonjurisdictional, except for utility systems that are subject
24 to, and remain subject to, interlocal utility agreements in
25 effect as of January 1, 1991, that create a single
26 governmental authority to regulate the utility systems whose
27 service transverses county boundaries, provided that no such
28 interlocal agreement shall divest commission jurisdiction over
29 such systems, any portion of which provides service within a
30 county that is subject to commission jurisdiction under s.
31 367.171.

1 Section 2. This act shall take effect upon becoming a
2 law.

5 HOUSE SUMMARY
6 Provides, with respect to water and wastewater systems,
that the exclusive jurisdiction of the Florida Public
7 Service Commission applies to each water or wastewater
utility facility which delivers water to or treats
8 wastewater from its customers in an adjacent county
through at least one pipe that crosses the county
9 boundary which separates those adjacent counties.
