1 A bill to be entitled
2 An act relating to voyeurism; creating s.
3 810.14, F.S.; prohibiting a person from
4 secretly observing or committing other acts
5 against another person with lewd, lascivious,
6 or indecent intent when the other person is in
7 a location that provides a reasonable
8 expectation of privacy; providing that a person
9 may be convicted and sentenced separately for
10 the voyeurism offense and for any other
11 criminal offense; providing for criminal
12 penalties; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Section 810.14, Florida Statutes, is
17 created to read:
18 810.14 Voyeurism prohibited; penalties.--
19 (1) A person commits the offense of voyeurism when he
20 or she, with lewd, lascivious, or indecent intent, secretly
21 observes, photographs, films, videotapes, or records another
22 person when such other person is located in a dwelling,
23 structure, or conveyance and such location provides a
24 reasonable expectation of privacy.
25 (2) A person may be convicted of and sentenced
26 separately for a violation of this section and for any other
27 criminal offense, including, but not limited to, burglary,
28 trespass, or loitering.
29 (3) A person who violates this section commits:
30 (a) A misdemeanor of the first degree for the first
31 violation, punishable as provided in s. 775.082 or s. 775.083.

1 (b) A felony of the third degree for a second or
2 subsequent violation, punishable as provided in s. 775.082, s.
3 775.083, or s. 775.084.
4 Section 2. This act shall take effect October 1, 1998.

6 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
7 Senate Bill 860

9 1. Provides that the offense of voyeurism is committed when
a person, with lewd, lascivious, or indecent intent,
10 secretly observes, photographs, films, videotapes, or
records another person when such other person is located
11 in a dwelling, structure, or conveyance and such location
provides a reasonable expectation of privacy.

2. Provides that a person may be convicted of and sentenced
13 separately for a violation of the new section and for any
other criminal offense, including but not limited to,
14 burglary, trespass, or loitering.
15 3. Provides that a first violation of the new section is a
first degree misdemeanor; a second or subsequent
16 violation is a third degree felony.
