Florida House of Representatives - 1997 HB 869 By the Committee on Health Care Services and Representative Albright 1 A bill to be entitled 2 An act relating to trust funds; creating s. 3 20.435(1)(a) and (2), F.S., relating to trust 4 funds of the Department of Health; creating the 5 Administrative Trust Fund within the 6 department; providing for sources of moneys and 7 purposes; providing for annual carryforward of 8 funds; providing for future review and 9 termination or re-creation of the trust fund; 10 providing a directive to the Division of 11 Statutory Revision; providing an effective 12 date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Paragraph (a) of subsection (1) and 17 subsection (2) of section 20.435, Florida Statutes, are 18 created to read: 19 20.435 Department of Health; trust funds.-- 20 (1) The following trust funds are hereby created, to 21 be administered by the Department of Health: 22 (a) Administrative Trust Fund. 23 1. Funds to be credited to the trust fund shall 24 consist of regulatory fees such as those pertaining to the 25 licensing, permitting, and inspection of septic tanks, food 26 hygiene, onsite sewage, Super Act compliance, solid waste 27 management, tanning facilities, mobile home and recreational 28 vehicle park inspection, other departmental regulatory and 29 health care programs, and indirect earnings from grants. 30 Funds shall be used for the purpose of supporting the 31 regulatory activities of the department and for other such 1 CODING: Words stricken are deletions; words underlined are additions. Florida House of Representatives - 1997 HB 869 169-396-97 1 purposes as may be appropriate and shall be expended only 2 pursuant to legislative appropriation or an approved amendment 3 to the department's operating budget pursuant to the 4 provisions of chapter 216. 5 2. Notwithstanding the provisions of s. 216.301 and 6 pursuant to s. 216.351, any balance in the trust fund at the 7 end of any fiscal year shall remain in the trust fund at the 8 end of the year and shall be available for carrying out the 9 purposes of the trust fund. 10 (2) Pursuant to the provisions of s. 19(f)(2), Art. 11 III of the State Constitution, each trust fund listed in 12 subsection (1) shall, unless terminated sooner, be terminated 13 on July 1, 2001. However, prior to its scheduled termination, 14 each trust fund listed in subsection (1) shall be reviewed as 15 provided in s. 215.3206(1) and (2). 16 Section 2. In editing manuscript for the next edition 17 of the official Florida Statutes, the Division of Statutory 18 Revision of the Joint Legislative Management Committee shall 19 incorporate within section 20.435, Florida Statutes, as 20 created by this act, all trust funds created within the 21 Department of Health by separate legislation, as required by 22 Section 19(f)(1) of Article III of the State Constitution, 23 during the 1997 Regular Session of the Legislature or any 24 extension thereof. 25 Section 3.
