11  Senator Dudley moved the following amendment:

13         Senate Amendment 

14         On page 22, lines 20-25, delete those lines

15

16  and insert:  Noncompliance with minimum applicable product

17  design, construction, or safety standards relevant to the

18  event causing the death or injury set forth in a federal or

19  state statute or rule, or lack of approval by a federal or

20  state agency responsible for reviewing the safety of the

21  product, shall raise a rebuttable presumption of negligence on

22  the part of a manufacturer or seller. The rebuttable

23  presumptions provided under this subsection shall not arise if

24  there are no applicable product design, construction, or

25  safety standards relevant to the event causing the death or

26  injury set forth in a federal or state statute or rule, or

27  there is no federal or state agency responsible for reviewing

28  the safety of the product.
