14 On page 36, before line 1,

16 insert:
17 Section 24. The Department of Insurance shall issue a
18 request for proposals and contract with an independent
19 actuarial firm to conduct an actuarial analysis of the
20 expected reduction in liability judgments, settlements, and
21 related costs resulting from the provisions of this act. As
22 part of the report, an analysis shall include an estimate of
23 the percentage decrease by type of coverage affected by the
24 provisions of this act, including the time period when such
25 savings or reductions are expected. The report shall be
26 completed and submitted to the department by March 1, 1999.
27 Each authorized insurer issuing any of the types of coverage
28 addressed in the analysis shall make a rate filing after March
29 1, 1999, but not later than October 1, 1999, that includes the
30 premium rate reduction percentages contained in the actuarial
31 analysis. The effective date of such premium reductions shall

1 be consistent with the time periods contained in the actuarial
2 analysis. The rate filing may also reflect other relevant
3 factors, as consistent with laws or rules affecting the rate
4 filing. If the insurer disputes the conclusions of the
5 actuarial analysis, the insurer shall establish in an
6 administrative, judicial, or other proceeding that the impact
7 of this act on such insurer's type of coverage is different
8 than the expected effects contained in the actuarial analysis.
