  1                      A bill to be entitled

  2         An act relating to limitations on actions;

  3         amending s. 95.11, F.S.; providing a time for

  4         bringing an action for wrongful death;

  5         providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Paragraph (d) of subsection (4) of section

10  95.11, Florida Statutes, is amended to read:

11         95.11  Limitations other than for the recovery of real

12  property.--Actions other than for recovery of real property

13  shall be commenced as follows:

14         (4)  WITHIN TWO YEARS.--

15         (d)  An action for wrongful death, with the period

16  running from the time the person entitled to sue discovers the

17  party responsible for the death even if the date of death is

18  known.

19         Section 2.  This act shall take effect October 1, 1998.

22                          SENATE SUMMARY

23    Provides that an action for damages for wrongful death
      must be brought within two years, with the period running
24    from the time the person entitled to sue discovers the
      party responsible for the death even if the date of death
25    is known.
