17         Section 5.  Subsections (6) and (7) of section 713.20,

18  Florida Statutes, 1996 Supplement, are amended to read:

19         713.20  Waiver or release of liens.--

20         (6)  A person may not require a lienor to furnish a

21  lien waiver or release of lien that is different from the

22  forms in subsection (4) or subsection (5); however, the lienor

23  may agree to furnish a form incorporated in the written

24  contract that only waives contract claims, other legal claims,

25  and equitable claims for the same period for which the lien

26  release applies.

27         (7)  A lienor who executes a lien waiver and release in

28  exchange for a check may condition the waiver and release on

29  payment of the check. However, the owner is not required to

30  make payment to the contractor until any such condition is

31  satisfied.
