  1                      A bill to be entitled

  2         An act relating to postconviction proceedings

  3         in capital cases; repealing Rule 3.852, Florida

  4         Rules of Criminal Procedure, relating to the

  5         production of records in postconviction

  6         proceedings in capital cases; providing a

  7         contingent effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Rule 3.852, Florida Rules of Criminal

12  Procedure, is repealed.

13         Section 2.  This act shall take effect July 1, 1998,

14  but it shall take effect only if enacted by the affirmative

15  vote of two-thirds of the membership of each house of the

16  Legislature.

19                          SENATE SUMMARY

20    Repeals Rule 3.852, Florida Rules of Criminal Procedure,
      which governs the production of public records for any
21    postconviction proceeding in a capital case. The act does
      not take effect unless enacted by a two-thirds vote of
22    each house of the Legislature.
