  1                      A bill to be entitled

  2         An act relating to motor vehicle insurance;

  3         amending s. 627.732, F.S.; including motor

  4         vehicles used as public school transportation

  5         in the definition of "motor vehicle" for

  6         insurance purposes; amending s. 627.733, F.S.;

  7         providing an exemption from a requirement to

  8         maintain certain financial security; providing

  9         an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Subsection (1) of section 627.732, Florida

14  Statutes, is amended to read:

15         627.732  Definitions.--As used in ss. 627.730-627.7405:

16         (1)  "Motor vehicle" means any self-propelled vehicle

17  with four or more wheels which is of a type both designed and

18  required to be licensed for use on the highways of this state

19  and any trailer or semitrailer designed for use with such

20  vehicle and includes:

21         (a)  A "private passenger motor vehicle," which is any

22  motor vehicle which is a sedan, station wagon, or jeep-type

23  vehicle and, if not used primarily for occupational,

24  professional, or business purposes, a motor vehicle of the

25  pickup, panel, van, camper, or motor home type.

26         (b)  A "commercial motor vehicle," which is any motor

27  vehicle which is not a private passenger motor vehicle.

29  The term "motor vehicle" does not include a mobile home or any

30  motor vehicle which is used in mass transit, other than or

31  public school transportation, and designed to transport more

  1  than five passengers exclusive of the operator of the motor

  2  vehicle and which is owned by a municipality, a transit or

  3  public school transportation authority, or a political

  4  subdivision of the state.

  5         Section 2.  Subsection (1) of section 627.733, Florida

  6  Statutes, is amended to read:

  7         627.733  Required security.--

  8         (1)  Every owner or registrant of a motor vehicle,

  9  other than a motor vehicle used as a taxicab, school bus as

10  defined in s. 234.051, or limousine, required to be registered

11  and licensed in this state shall maintain security as required

12  by subsection (3) in effect continuously throughout the

13  registration or licensing period.

14         Section 3.  This act shall take effect October 1, 1997,

15  and shall apply to policies issued on or after such date.

18                          HOUSE SUMMARY

19    Includes in the definition of "motor vehicle" for
      insurance purposes motor vehicles used as public school
20    transportation.  Exempts owners of school buses from
      financial security requirements.  See bill for details.
