1 A bill to be entitled
2 An act relating to funding of public education;
3 creating s. 215.155, F.S.; providing for annual
4 funding of public education at a specified
5 percentage of total appropriations, not
6 including lottery proceeds or federal funds;
7 providing the basis for such percentage;
8 providing conditions for temporary suspension
9 of such requirement; providing applicability;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 215.155, Florida Statutes, is
15 created to read:
16 215.155 Required appropriations for public schools,
17 state institutions of higher learning, and community colleges;
18 intent; annual minimum; temporary suspension;
19 implementation.--
20 (1) It is the intent of the Legislature to implement
21 by statute the provisions of s. 1, Art. IX of the State
22 Constitution requiring adequate funding of public education.
23 (2) Adequate funding of public education is required
24 each fiscal year and shall consist of the appropriation for
25 public education purposes of not less than 40 percent of total
26 appropriations under Article III of the State Constitution in
27 each fiscal year, not including lottery proceeds or federal
28 funds. The minimum percentage specified in this subsection is
29 based on the percentage appropriated for public education from
30 total appropriations in fiscal year 1986-1987, not including

1 federal funds and prior to adoption of the Florida Education
2 Lotteries and the appropriation of funds therefrom.
3 (3) The Legislature may suspend the applicability of
4 this section for any one fiscal year, or portion of a fiscal
5 year, by passage of a separate bill which may contain no other
6 subject and which must contain a statement of compelling
7 public necessity. Passage of such a bill requires a vote of
8 two-thirds of the membership of each house.
9 (4) This section shall apply to appropriations for
10 fiscal year 2000-2001 and each fiscal year thereafter.
11 Section 2. This act shall take effect upon becoming a
12 law.

Provides for annual funding of public education at not
17 less than 40 percent of each year's total appropriations,
not including lottery proceeds or federal funds.
18 Authorizes the Legislature to suspend such requirement in
any one fiscal year or portion of a fiscal year by means
19 of a separate bill limited to that subject and passed by
a two-thirds vote of the membership of each house.
20 Provides for implementation beginning with fiscal year
2000-2001.
