2 An act relating to Hillsborough County;
3 amending chapter 95-488, Laws of Florida;
4 authorizing the Tampa Port Authority to
5 delegate control and regulation of submerged
6 lands; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 7 of chapter 95-488, Laws of
11 Florida, is amended to read:
12 Section 7. POWERS.--The port authority shall have all
13 the powers necessary to carry out the provisions of this act.
14 The port authority shall have the specific responsibility of
15 planning and of carrying out plans for the long-range
16 development of the facilities of and traffic through the port
17 in the port district. The port authority, prior to acquiring
18 ownership, control, or undertaking the operation of any
19 project, shall give 20 days' notice of a public hearing, at
20 which hearing the public's views shall be heard; except that
21 such public hearing is not required if the ownership, control,
22 or undertaking of operation constitutes or is occasioned by
23 the retaking of possession, ownership, or control of the
24 project by the port authority through lease termination,
25 default or eviction proceeding, bankruptcy proceeding, or
26 settlement with a tenant in lieu of such proceeding or if the
27 total cost to the port authority of acquiring, controlling, or
28 undertaking operation of the project does not exceed the
29 amount specified in section 15. Such notice shall be made by
30 advertisement in a newspaper of general circulation published
31 in the port district, with a brief description of the general

1 nature of the project. Without in any manner limiting or
2 restricting the other powers conferred upon it, the port
3 authority shall have the power:
4 (z) To delegate control and regulation of submerged
5 lands including the issuance of minor work permits and other
6 permits by entering into contracts or interlocal agreements
7 adopted pursuant to applicable law.
8 Section 2. This act shall take effect upon becoming a
9 law.
