  1                      A bill to be entitled

  2         An act relating to the Department of

  3         Environmental Protection; amending s. 20.255,

  4         F.S.; prescribing the divisions within the

  5         department; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (6) of section 20.255, Florida

10  Statutes, is amended to read:

11         20.255  Department of Environmental Protection.--There

12  is created a Department of Environmental Protection.

13         (6)  The following divisions of the Department of

14  Environmental Protection are established:

15         (a)  Division of Administrative and Technical Services.

16         (b)  Division of Air Resource Management.

17         (c)  Division of Water Resources Facilities.

18         (d)  Division of Law Enforcement.

19         (e)  Division of Marine Resources.

20         (f)  Division of Waste Management.

21         (g)  Division of Recreation and Parks.

22         (h)  Division of State Lands, the director of which is

23  to be appointed by the secretary of the department, subject to

24  confirmation by the Governor and Cabinet sitting as the Board

25  of Trustees of the Internal Improvement Trust Fund.

26         (i)  Division of Environmental Resource Permitting.

28  In order to ensure statewide and intradepartmental

29  consistency, the department's divisions shall direct the

30  district offices and bureaus on matters of interpretation and

31  applicability of the department's rules and programs.

  1         Section 2.  This act shall take effect July 1, 1998.

  4                          SENATE SUMMARY

  5    Changes the name of the Division of Water Facilities to
      the Division of Water Resources in the Department of
  6    Environmental Protection and deletes the Division of
      Environmental Resource Permitting.
