  1                      A bill to be entitled

  2         An act relating to selection of probation and

  3         parole office space by the Department of

  4         Corrections; amending s. 945.28, F.S.;

  5         requiring the department to advise by letter

  6         the county or municipal administrator 30 days

  7         prior to signing the lease or purchasing the

  8         property for intended probation or parole

  9         office space which is contiguous to a place

10         where children or a population especially

11         vulnerable to crime due to age or physical or

12         mental disability regularly congregates;

13         providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  Section 945.28, Florida Statutes, is

18  amended to read:

19         945.28  Selection of probation or parole offices by the

20  department; public notice.--

21         (1)  Beginning July 1, 1995, whenever the department is

22  going to enter into a contract for the lease or purchase of a

23  probation or parole office space to be used by the department,

24  the department shall provide notice, by publication in the

25  county in which the office space is to be located, in a

26  newspaper of general circulation in said county, 30 days prior

27  to signing any lease or purchasing any property to be used for

28  office space, that the department intends to lease or purchase

29  such property.  The published notice shall include a telephone

30  number whereby interested members of the public may

31  communicate with the department with respect to any questions

  1  or input the public may have with regard to the proposed lease

  2  or purchase.

  3         (2)  When the site of the proposed probation or parole

  4  office space is to be located contiguous to a school for

  5  children in grade 12 or lower, day care center facility, park,

  6  playground, or other place where children or a population

  7  especially vulnerable to crime due to age or physical or

  8  mental disability regularly congregates, the department shall

  9  advise by letter the county or city administrator in the

10  county or city in which the office space is to be located 30

11  days prior to signing any lease for or purchasing any property

12  for the intended use of a probation or parole office.

13         Section 2.  This act shall take effect July 1, 1997.
