  1                      A bill to be entitled

  2         An act relating to selection of probation and

  3         parole office space by the Department of

  4         Corrections; amending s. 945.28, F.S.;

  5         requiring the department to provide written

  6         notification to the county or municipal

  7         administrator 30 days prior to signing the

  8         lease or purchasing the property for intended

  9         probation or parole office space which is

10         within one quarter mile of a place where

11         children or a population especially vulnerable

12         to crime due to age or physical or mental

13         disability regularly congregates; providing an

14         effective date.

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  Section 945.28, Florida Statutes, is

19  amended to read:

20         945.28  Selection of probation or parole offices by the

21  department; public notice.--

22         (1)  Beginning July 1, 1995, whenever the department is

23  going to enter into a contract for the lease or purchase of a

24  probation or parole office space to be used by the department,

25  the department shall provide notice, by publication in the

26  county in which the office space is to be located, in a

27  newspaper of general circulation in said county, 30 days prior

28  to signing any lease or purchasing any property to be used for

29  office space, that the department intends to lease or purchase

30  such property.  The published notice shall include a telephone

31  number whereby interested members of the public may

  1  communicate with the department with respect to any questions

  2  or input the public may have with regard to the proposed lease

  3  or purchase.

  4         (2)  When the site of the proposed probation or parole

  5  office space is to be located within one quarter mile of a

  6  school for children in grade 12 or lower, licensed day care

  7  center facility, park, playground, nursing home, convalescent

  8  center, hospital, association for disabled population, mental

  9  health center, youth center, group home for disabled

10  population or youth, or other place where children or a

11  population especially vulnerable to crime due to age or

12  physical or mental disability regularly congregates, the

13  department shall provide written notification to the county or

14  city administrator in the county or city in which the office

15  space is to be located simultaneously with the newspaper

16  publication.

17         Section 2.  This act shall take effect July 1, 1997.
