  1                      A bill to be entitled

  2         An act relating to cruelty to animals; amending

  3         s. 828.12, F.S.; making certain types of animal

  4         exhibitions a crime; providing an effective

  5         date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Present subsections (2) and (3) of section

10  828.12, Florida Statutes, are redesignated as subsections (3)

11  and (4), respectively, and a new subsection (2) is added to

12  that section to read:

13         828.12  Cruelty to animals.--

14         (2)  A person who unnecessarily conducts, finances,

15  manages, or participates in a commercial animal exhibition in

16  which horses, mules, or donkeys are encouraged or required to

17  fall or jump a distance of 5 feet at a time downward, is

18  guilty of a misdemeanor of the first degree, punishable as

19  provided in s. 775.082 or by a fine of not more than $5,000,

20  or both.

21         Section 2.  This act shall take effect October 1, 1998.

25    Makes it a crime for commercial animal exhibitors to have
      certain types of equine animals jump downward 5 feet or
26    more.
