  1                      A bill to be entitled

  2         An act relating to candidates for public

  3         office; amending s. 99.012, F.S.; removing a

  4         requirement that certain subordinate officers,

  5         deputy sheriffs, or police officers must take a

  6         leave of absence without pay during the period

  7         in which he or she is a candidate for public

  8         office; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (5) of section 99.012, Florida

13  Statutes, is amended to read:

14         99.012  Restrictions on individuals qualifying for

15  public office.--

16         (5)  A person who is a subordinate officer, deputy

17  sheriff, or police officer need not resign pursuant to this

18  section unless the person is seeking to qualify for a public

19  office which is currently held by an officer who has authority

20  to appoint, employ, promote, or otherwise supervise that

21  person and who has qualified as a candidate for reelection to

22  that office. However, upon qualifying, the subordinate

23  officer, deputy sheriff, or police officer must take a leave

24  of absence without pay during the period in which he or she is

25  a candidate for office.

26         Section 2.  This act shall take effect upon becoming a

27  law.
