  1                      A bill to be entitled

  2         An act relating to government procurement of

  3         personal property and services; amending s.

  4         287.133, F.S.; redefining the term "public

  5         entity," for purposes of denying persons

  6         convicted of public entity crimes the right to

  7         bid on or accept contracts with public

  8         entities, to include the Legislature; creating

  9         s. 287.0015, F.S.; requiring the Legislature to

10         procure commodities and services in conformity

11         with the public-bidding requirements applicable

12         to the executive branch; providing an effective

13         date.

15  Be It Enacted by the Legislature of the State of Florida:

16

17         Section 1.  Paragraph (f) of subsection (1) of section

18  287.133, Florida Statutes, is amended to read:

19         287.133  Public entity crime; denial or revocation of

20  the right to transact business with public entities.--

21         (1)  As used in this section:

22         (f)  "Public entity" means the State of Florida, any

23  department of its departments or agency of the state agencies,

24  or any political subdivision of the state, or the Legislature.

25         Section 2.  Section 287.0015, Florida Statutes, is

26  created to read:

27         287.0015  Legislative procurement of commodities and

28  services; competitive bid requirements--The Legislature, when

29  procuring commodities and services, shall follow the

30  requirements with respect to use of competitive bidding which

  1  are applicable to agencies of the executive branch under this

  2  chapter.

  3         Section 3.  This act shall take effect July 1, 1998.

  6                          SENATE SUMMARY

  7    Prohibits persons convicted of public entity crimes from
      bidding on or entering into contracts to furnish
  8    commodities or services to the Legislature in excess of a
      specified amount.  Requires the Legislature to follow the
  9    same procedures with respect to acquisition of
      commodities and services competitive bidding as are
10    imposed on agencies of the executive branch.
