8 inspection fee; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 325.2135, Florida Statutes, 1998
13 Supplement, is amended to read:
14 325.2135 Motor vehicle emissions inspection program;
15 development of specifications; fees; reporting.--
16 (1) The Department of Highway Safety and Motor
17 Vehicles shall hire an independent expert consultant to
18 develop appropriate request-for-proposal specifications and a
19 range of inspection fees for the motor vehicle emissions
20 inspection program based on an annual and a biennial
21 inspection program for vehicles 4 model years old and older,
22 using the basic test for hydrocarbon emissions and carbon
23 monoxide emissions and other mobile source testing for nitrous
24 oxides or other pollutants, and no later than January 1, 1999,
25 to report to the President of the Senate and the Speaker of
26 the House of Representatives setting forth the relevant facts
27 and the department's recommendations. Notwithstanding the
28 provisions of chapter 325, the department and the Governor and
29 Cabinet, acting as head of that agency, are prohibited from
30 entering into any contract or extension of a contract for any
31 form of motor vehicles emissions testing without legislative

1 approval through the enactment of specific legislation
2 directing the department to implement an inspection program
3 and establishing a fee for the program.
4 (2) If no specific legislation is passed during the
5 1999 legislative session to direct the department to implement
6 a motor vehicle inspection program, The department must may
7 issue a request for proposal and enter one or more contracts
8 on or before May 1, 2000, for a biennial inspection program
9 for vehicles 4 5 model years and older using the basic test
10 for hydrocarbon emissions and carbon monoxide emissions. Any
11 contract authorized under this section must contain a
12 provision requiring that the average driving distance from
13 residences to inspection stations be no more than 6 miles for
14 at least 90 percent of the affected registered motor vehicle
15 owners in the designated program areas. The requirements for
16 the program included in the proposals must be based on the
17 requirements under chapter 325 unless those requirements
18 conflict with this section. No contract entered into under
19 this subsection may be for longer than 5 2 years. Any contract
20 authorized under this section must provide that the department
21 reserves the right to cancel a contract at any time before the
22 conclusion of the contract term upon 6 months notice to the
23 contractor. Notwithstanding the provisions of s. 325.214, if
24 the fee for motor vehicle inspection proposed by the
25 Department of Highway Safety and Motor Vehicles may not will
26 exceed $20 $10 per inspection., the department may impose the
27 higher fee if such fee is approved through the budget
28 amendment process set forth in chapter 216 and notice is
29 provided to the chairmen of the Senate and House
30 Transportation and Natural Resources Committees at the time it

1 is provided to the Senate Ways and Means and House
2 Appropriations Committees.
3 Section 2. Subsection (2) of section 325.214, Florida
4 Statutes, 1998 Supplement, is amended to read:
5 325.214 Motor vehicle inspection; fees; disposition of
6 fees.--
7 (2) The inspection fee may not exceed $20 shall be
8 $10. Notwithstanding any other provision of law to the
9 contrary, an additional fee of $1 shall be assessed upon the
10 issuance of each dealer certificate, which fee shall be
11 forwarded to the department for deposit into the Highway
12 Safety Operating Trust Fund.
13 Section 3. This act shall take effect upon becoming a
14 law.
