1 A bill to be entitled
2 An act relating to instructional materials;
3 amending s. 233.25, F.S., requiring publishers
4 and manufacturers to retain instructional
5 materials in a depository for a specified
6 period of time; amending s. 233.34, F.S.;
7 allowing certain school districts to use
8 certain funds to purchase instructional
9 materials; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsection (12) of section 233.25, Florida
14 Statutes, is amended, present subsections (13) and (14) of
15 that section are redesignated as subsections (15) and (16),
16 respectively, and new subsections (13) and (14) are added to
17 that section to read:
18 233.25 Duties, responsibilities, and requirements of
19 publishers and manufacturers of instructional
20 materials.--Publishers and manufacturers of instructional
21 materials, or their representatives, shall:
22 (12) Maintain, or contract with, a depository in the
23 state and maintain there an inventory sufficient to receive
24 and fill orders for instructional materials.
25 (13) Maintain in the depository for no longer than 2
26 years textbooks in an amount sufficient to receive and fill
27 orders.
28 (14) Maintain in the depository for no longer than 1
29 year ancillary instructional materials in an amount sufficient
30 to receive and fill orders.

1 Section 2. Present subsections (3), (4), (5), and (6)
2 of section 233.34, Florida Statutes, are redesignated as
3 subsection (4), (5), (6), and (7), respectively, and a new
4 subsection (3) is added to that section to read:
5 233.34 Use of instructional materials allocation;
6 instructional materials, library books, and reference books;
7 repair of books.--
8 (3) Each school district that meets the current and
9 previous terms of adoption for instructional materials may use
10 up to 75 percent of its annual allocation for the purchase of
11 any instructional materials, including technology. However,
12 the funds available under this subsection to school districts
13 for the purchase of materials not on the state adopted list
14 may not be used to purchase electronic or computer hardware,
15 even if the hardware is bundled with software or other
16 electronic media, nor may the funds be used to purchase
17 equipment or supplies.
18 Section 3. This act shall take effect July 1, 1999.

21 SENATE SUMMARY
22 Requires publishers and manufacturers of instructional
materials to maintain them for a specified period of
23 time. Allows a qualified school district to use a
percentage of its annual allocation for the purchase of
24 any instructional materials.
